Tennessee Firearms Association

 

Tennessee law (T.C.A. § 39-17-1359) provides:

An individual, corporation, business entity or local, state or federal government entity or agent thereof is authorized to prohibit the possession of weapons by any person otherwise authorized by §§ 39-17-1351 -- 39-17-1360, at meetings conducted by, or on premises owned, operated, or managed or under control of such individual, corporation, business entity or government entity. Notice of such prohibition shall be posted. Posted notices shall be displayed in prominent locations, including all public entrances, shall be in English, and shall be at least six inches (6") high and fourteen inches (14") wide, stating:

PURSUANT TO T.C.A. § 39-17-1359, THE OWNER/OPERATOR OF THIS PROPERTY HAS BANNED WEAPONS WITHIN THIS BUILDING OR THIS PORTION OF THIS BUILDING. A VIOLATION OF THIS PROHIBITION IS PUNISHABLE AS A CRIMINAL ACT UNDER STATE LAW AND MAY BE SUBJECT TO A FINE OF NOT MORE THAN $500.

Some property owners and businesses in Tennessee have posted their properties prohibiting the exercise of the carry permit. If you carry your handgun (even with your carry permit) onto posted property you may be committing a crime which could cause you to be criminally fined, which could result in the loss of your handgun by forfeiture, and which could possibly even cause you to lose your handgun carry permit.

You should be aware of where you can and cannot carry your handgun with your permit. Some businesses that once posted their property have changed their policy because of public pressure and loss of business. It is your responsibility to know the locations that are posting. It is also your decision whether or not to continue doing business with them. If you know of such a business, use the TFA Banning Business Letter Generator to write them a letter expressing your opposition to their policy.

THIS LIST IS BELIEVED TO BE ACCURATE - HOWEVER, ALWAYS CHECK WITH THE PROPERTY MANAGER IF YOU HAVE ANY DOUBTS.

Those locations identified above prohibit all possession of firearms.  Please note that there are some businesses that are required by law to post that firearms are prohibited by law on the property.    There are some other businesses which are requesting that there be "no loaded weapons" on their property.  It is unclear under current law whether a notice of "no loaded weapons" would be classified as a "posted property" for purposes of current state law.   Clearly, many of these business owners, including gun ranges, welcome gun owners with firearms onto their property but for insurance or related safety concerns, i.e., increased frequency of invitees handling weapons, they must request that these personal firearms remain unloaded while on premises.   For example, most firing ranges prohibit possession of loaded weapons unless the individual is on the firing line.

The following properties were once on the posted properties list but it has been reported to TFA that they REMOVED the notices:

  • Harding Mall (Nashville)
  • Down Range, Inc.
  • Home Depot (see letter December 5, 2003, from Home Depo) asserting that it does not prohibit those legally carrying but that it has a "long standing" policy which prohibits employees from carrying weapons in the stores
  • Lowe's Hardware Stores
  • TDOT Interstate Rest Stops (see letter December 9, 2003, from TDOT claiming it was a mistake)
  • Wolfchase Galleria (Note: "mall rules" prohibit weapons but exempts "licensed hand gun carriers."  However, we have had reports that the mall security is "carding" people and issuing criminal trespass notices).

Contact the Tennessee Firearms Association to report other locations which are being posted.
